1. Definitions
Company means Fish Dundee Boat Hire.
Renter means the individual or group hiring the vessel.
Vessel means the boat hired under this agreement, including all supplied equipment and accessories.
2. Rental Eligibility
Renters must be at least 18 years of age and provide valid government-issued identification upon request.
The renter must be capable of safely operating a recreational vessel and accept responsibility for all passengers during the hire period.
3. Rental Period
The rental period begins at the agreed departure time and ends when the vessel is returned to the designated return location at Dundee Beach. Late returns may incur additional charges.
The renter must notify Fish Dundee Boat Hire immediately if they expect to be delayed.
4. Security Deposit
A security deposit of AUD $500 per vessel is required prior to departure. Cash is preferred.
The security deposit will be refunded following completion of the return inspection, subject to the vessel being returned in satisfactory condition.
Deductions may be made for:
- Damage to the vessel, motor or trailer.
- Damage to the propeller or lower unit.
- Lost or damaged equipment.
- Excessive cleaning requirements.
- Fuel charges where applicable.
- Fines, penalties or infringements incurred during the hire period.
- Any other costs arising from the renter's use of the vessel.
5. Fuel
The vessel is supplied with a full fuel tank and must be refilled at the end of each day. No jerry cans.
All fuel costs used during the hire period are the responsibility of the renter.
6. Use of Vessel
The vessel must only be operated within areas approved by Fish Dundee Boat Hire during the safety briefing.
The vessel must not be used:
- Under the influence of alcohol or drugs.
- For racing, towing or commercial activities.
- In unsafe weather or sea conditions.
- In restricted areas advised by Fish Dundee Boat Hire.
The renter must comply with all Northern Territory maritime regulations and safety requirements.
7. Weather Conditions and Operating Restrictions
Fish Dundee Boat Hire operates in a dynamic marine environment and weather conditions can change rapidly.
Customers are encouraged to monitor weather conditions using the weather resources provided by Fish Dundee Boat Hire, including Windy and WillyWeather.
Where forecast offshore wind speeds are predicted to reach or exceed 15 knots, a NO GO offshore condition applies.
During a NO GO offshore condition:
- Vessels must remain within 1 nautical mile of shore.
- Offshore fishing areas must not be accessed.
- Additional operating restrictions may be imposed by Fish Dundee Boat Hire.
Fish Dundee Boat Hire reserves the right to:
- Restrict operating areas.
- Delay departures.
- Recall vessels.
- Cancel bookings where conditions are considered unsafe.
Where weather conditions significantly impact a customer's planned fishing activities, Fish Dundee Boat Hire will work with customers to provide a suitable alternative including rescheduling, booking credit or refund at the Company's discretion.
8. Safety
A safety briefing will be provided prior to departure.
The renter agrees to follow all instructions provided by Fish Dundee Boat Hire.
The renter is responsible for ensuring all passengers comply with applicable safety requirements, including the use of lifejackets where required.
Failure to follow safety instructions may result in termination of the hire without refund.
9. Responsibility and Liability
The renter accepts full responsibility for the vessel and all passengers during the hire period.
The renter is liable for any loss, damage, injury, costs or claims arising from the use of the vessel during the hire period.
Fish Dundee Boat Hire accepts no responsibility for:
- Personal injury.
- Loss of personal property.
- Damage to personal belongings.
- Consequential loss arising from cancellation, weather conditions or mechanical breakdown.
Any accident, collision, damage, grounding or mechanical issue must be reported to Fish Dundee Boat Hire immediately.
10. Vessel Condition and Cleaning
The vessel will be supplied in clean and serviceable condition.
The vessel must be returned in a similar condition.
Cleaning charges may apply where excessive cleaning is required:
- Dirty Vessel: $100 – bait and/or blood left on gunwales or bait station.
- Excessively Dirty Vessel: $200 – bait, hooks or rubbish left on floor.
11. Cancellations and Refunds
Customer cancellations should be made as early as possible.
Cancellations made more than 48 hours prior to departure may be eligible for a refund, credit or reschedule, subject to the Company's booking policy.
Fish Dundee Boat Hire reserves the right to cancel bookings due to:
- Unsafe weather conditions.
- Mechanical issues.
- Safety concerns.
- Operational requirements.
Where Fish Dundee Boat Hire cancels a booking, customers may choose a reschedule, booking credit or full refund.
12. Governing Law
This agreement is governed by the laws of the Northern Territory of Australia.
13. Acceptance
By making a booking, signing a hire agreement, accepting these terms electronically, or paying any booking fees or security deposit, the renter acknowledges that they have read, understood and agreed to these Terms and Conditions.
