Terms and Conditions – Fish Dundee Boat Hire

1. Definitions

  • “Company” means Fish Dundee Boat Hire, the boat rental provider.

  • “Renter” means the individual or group hiring the vessel.

  • “Vessel” means the boat hired under this agreement.


2. Rental Eligibility

  • Renters must be 18 years or older and provide valid government-issued identification


3. Rental Period

  • The rental period begins at the agreed start time and ends when the vessel is returned to the designated location at Dundee Beach.

  • Late returns may incur additional charges at the standard hourly rate.


4. Security Bond

  • A refundable security bond of AUD $500 is required before departure.

  • The bond may be paid by credit card or cash.

  • The bond will be refunded within 3 business days after the vessel is returned in satisfactory condition.

  • Deductions may be made for:

    • Damage to the vessel, motor, or equipment.

    • Loss of equipment (anchors, lifejackets, safety gear, etc.).

    • Cleaning fees if the vessel is returned excessively dirty.

    • Refuelling costs if the vessel is not returned with a full tank.

    • Any fines, penalties, or infringements incurred during the rental period.


5. Use of Vessel

  • The vessel must only be used within approved areas as advised by Fish Dundee Boat Hire.

  • The vessel must not be used:

    • Under the influence of alcohol or drugs.

    • For towing, racing, or commercial purposes.

    • In restricted or unsafe waters.

  • The renter must ensure all passengers comply with NT maritime safety laws, including wearing lifejackets where required.


6. Responsibility and Liability

  • The renter accepts full responsibility for the vessel and all passengers during the rental period.

  • The renter is liable for any damage, loss, or third-party claims arising from the use of the vessel.

  • Fish Dundee Boat Hire is not liable for personal injury, loss, or damage to personal belongings.

  • Any accident, damage, or mechanical issue must be reported to the Company immediately.


7. Cancellations and Refunds

  • Cancellations must be made at least 48 hours prior to the booking to qualify for a refund.

  • The Company reserves the right to cancel bookings due to unsafe weather conditions, mechanical issues, or operational reasons. In such cases, renters may choose a full refund or reschedule.


8. Safety

  • A safety briefing will be provided prior to departure.

  • The renter must follow all safety instructions given by the Company.

  • Failure to follow safety guidelines may result in termination of the rental without refund.


9. Governing Law

  • This agreement is governed by the laws of the Northern Territory, Australia.


10. Acceptance

By signing this agreement and/or paying the $500 security bond, the renter acknowledges they have read, understood, and agreed to these Terms and Conditions.
